In an order released August 28, the agency's Public Safety and Homeland Security Bureau and Office of Engineering and Technology formally denied three separate requests to extend the public comment period in PS Docket No. 26-189 — the proceeding that could bar a wide swath of foreign-made drones from FCC authorization on national-security grounds. The comment window closes September 2, exactly as originally scheduled.
The docket, opened with an August 3 Federal Register notice, asks whether the FCC should prohibit the importation and marketing of what it defines as "military-grade" unmanned aircraft systems and UAS critical components produced by foreign entities. The three rejected extension requests came not from drone manufacturers but from trade and professional associations: the American Fuel & Petrochemical Manufacturers (AFPM), which filed August 4; the public-safety group DRONERESPONDERS (DR), which filed August 24; and the Commercial Drone Alliance (CDA), which filed August 26. AFPM said it needed time to survey its members on how reliant their operations are on equipment that could be affected, calling the proceeding's underlying questions "complex technical questions that require careful analysis." DR asked the FCC to push the deadline from September 2 to September 30, citing a need to consult affected organizations on "equipment supply chains, cybersecurity mitigations, public safety needs, and national security" considerations. CDA backed that request.
What the FCC Is Actually Proposing
The Federal Register notice lays out seven characteristics the FCC would treat as markers of a "military-grade" drone. According to the notice, that definition covers UAS equipped with thermal imaging, LiDAR sensors, or automated docking stations; aircraft weighing 55 pounds or more; drones fitted with chemical dispensers; ground control stations or flight systems specially designed to manage autonomous drone swarms; and any UAS "specially designed to incorporate a defense article." Any foreign-produced aircraft or critical component meeting these criteria could lose eligibility for FCC equipment authorization — the certification that allows a device to legally transmit radio-frequency signals and be sold in the United States.
Losing that authorization is not a cosmetic problem. Without it, a drone cannot legally be imported, marketed, or sold in the U.S. market, regardless of whether the aircraft is destined for a battlefield or a rooftop solar inspection.
The proposal also includes a transition mechanism: reporting by DroneXL indicates the docket contemplates a 180-day wind-down period during which foreign hardware already on the market could continue to be sold or supported before the restrictions take full effect. That timeline has done little to calm industry nerves, since the categories at issue — thermal cameras, LiDAR, docking stations — are now standard equipment on drones used far outside any military context.
DJI's Objection: This Is Everyday Hardware
DJI, the Chinese manufacturer that dominates the global consumer and prosumer drone market, has been the most vocal opponent of the docket. In a statement reported by DroneLife on August 10, the company warned that "the same models in use today might no longer be available to purchase in the future" if the rule proceeds as written, and called the move "a total reversal from the FCC's previous position." DJI's argument is straightforward: LiDAR, thermal sensors, and docking stations aren't exotic military add-ons — they're the baseline feature set for drones used in infrastructure inspection, precision agriculture, and public-safety response. DroneXL's coverage of the docket names specific consumer and prosumer models that fall under the LiDAR category as drafted, including the DJI Air 3S, Mini 5 Pro, Avata 360, and Neo 2 — aircraft marketed to hobbyists and small businesses, not defense contractors. The August 28 order does not reopen or narrow the substance of the docket — it simply closes the door on delay. The FCC document states that the Public Safety and Homeland Security Bureau and the Office of Engineering and Technology denied all three extension requests, leaving the original September 2 deadline from the August 3 Federal Register notice untouched. The order does spell out its rationale: it states that "extensions of time shall not be routinely granted" and that the "national security considerations undergirding the proposal require that public comment be provided to the Commission as soon as possible." The practical effect is clear: commenters — including DJI, trade associations, and any other affected party — now have a hard, unmoved deadline to file objections, technical corrections, or requests to narrow the "military-grade" definition before the record closes.
